On 30 June 2021, Ohio state Governor, Mike DeWine, signed a Bill which would enact the state's budget for the next two years. In addition to its core funding imperatives, the Bill also contained an amendment significantly expanding entitlements of health care providers to conscientiously object to professional duties to provide controversial health care services. This amendment has been heavily criticised as providing the means to allow health care providers to discriminate against a wide range of persons by denying them (...) access to often contested services such as abortion and contraception. In this paper, we examine the implications of this amendment and situate it in relation to other legislative actions intended to guarantee absolute rights to conscientious objection. In doing so, we argue that the entitlements extended to health care providers by these Bills are overly broad and ignore their potential to allow significant harm to be caused to clients. We then argue that if health care providers should have rights to conscientiously object, then any legislation intended to protect such rights should be limited, specific, and parsimonious. Where it is not, the ideological liberty of HCPs treads dangerously on the physical freedom of their clients. (shrink)

As is well known, some paradoxes arise through inadequate analysis of the meanings of terms in a language, an adequate analysis showing that the paradoxes arise through a lack of separation of an object theory and a metatheory. Under such an adequate analysis in which parts of the metatheory are modelled in the object theory, the paradoxes give way to remarkable theorems establishing limitations of the object theory.Such a modelling is often accomplished by a Gödel numbering. Here we shall use (...) a somewhat different technique in axiomatic set theory, from which we shall reap a few results having the effect of comparing the strength of various axiom schema of comprehension for sets and classes. Heinrich Heine had not only many places of residence during his years in Germany, but he also made numerous journeys throughout Europe. Thus, during his time in France, he got to know the country substantially better and furthermore he would have liked to undertake a detour to Spain. Since his student days, Spain was for him as a German Jew the epitome of a Jewish- Christian-Islamic symbiosis despite many differences and difficulties. He slipped into the role of the Moors to (...) express his own outsider role within the German Christian majority society. Heine admired the great Jewish achievements and remained critical of Christian claims, although he had become a Protestant after being baptized at the end of his law studies. His tragedy Almansor, poems from the Buch der Lieder, texts in prose and epic poems from the Parisian years as well as in his literary bequest and above all the last collection of poems called Romanzero with their moving “Spanish” texts, namely the stories about Jews, Christians and Muslims, are the most important poetic evidences of religious coexistence and its problems. Heine is one of Germany's most renowned poets. His Jewish heritage and his Christian baptism have informed both his life's work as well as its reception. He was an expert and a passionate reader of the Bible. Despite his criticism of the official system of churches and religious communities, he greatly appreciated religion and its symbolic language, which speaks especially to the poet – even in its silences.

Die nach den Konventionen der Alten Geschichte gemeinhin mit dem Beginn der Regierungszeit des Kaisers Diokletian (284 n. Chr.) einsetzende Epoche der Spätantike (die Papyrologen sprechen seit diesem Zeitpunkt dagegen zumeist von der „Byzantinischen Zeit“) zeitigte eine Fülle von administrativen und fiskalischen Reformen, die sich auch in Änderungen der Zeitrechnung in den Provinzen des Reiches niederschlugen. Am besten studieren lassen sich diese Auswirkungen in der Provinz Ägypten, wo mit den Papyri eine Fülle von datierten administrativen Aufzeichnungen sowie öffentlichen und privaten (...) Urkunden zur Verfügung steht. Hier manifestiert sich in diesen Phänomenen zugleich die zunehmende Angleichung Ägyptens an die administrativen und fiskalischen Strukturen in den anderen Provinzen des Reiches, wenn man so will die „Romanisierung“ Ägyptens, deren Ergebnis das Verschwinden zahlreicher Besonderheiten war, durch welche sich in der frühen und hohen Kaiserzeit die Verhältnisse in Ägypten von denen in den übrigen Teilen des Reiches signifikant unterschieden haben, wenngleich dieser Umstand es nach der Auffassung des Rez. keinesfalls rechtfertigt, der Provinz als solcher einen Sonderstatus im römischen Reichsverband zuzuschreiben, wie dies eine traditionelle Richtung der althistorischen Forschung lange Zeit getan hat und teilweise immer noch tut. Die weltweit besten Kenner der diversen chronologischen Systeme des byzantinischen Ägypten und der mit ihnen zusammenhängenden, z. T. äußerst verwickelten Probleme sind zweifellos Roger S. Zutphen 1978) eine Summe der aus ihrer Editionstätigkeit erwachsenden intensiven Beschäftigung mit den chronologischen Problemen byzantinischer Urkunden aus Ägypten vorgelegt und nicht nur dem Editor solcher Dokumente im besonderen, sondern auch der historischen und papyrologischen Forschung im allgemeinen ein unentbehrliches Hilfsmittel an die Hand gegeben haben. Schon ein Jahr später folgten mit den aus ihrer Feder stammenden „Regnal Formulas in Byzantine Egypt“ (RFBE. Bulletin of the American Society of Papyrologists, Supplement 2. Missoula/Montana 1979) und 1987 mit den zusammen mit A. Cameron und S. Schwartz verfaßten „Consuls of the Later Roman Empire“ (CLRE) zwei weitere solcher unverzichtbaren Hilfsmittel, die den auf dem Gebiet der epigraphischen und papyrologischen Hinterlassenschaft der Spätantike tätigen Forschern die Arbeit beträchtlich erleichtern. In Anbetracht des in der seit dem Erscheinen von CSBE vestrichenen Zeit enorm angewachsenen Quellenmaterials, welches nicht nur vielfältige neue chronologische Probleme aufwarf, sondern auch bereits bekannte in neuem Licht erscheinen ließ – einen Prozeß, den B&W mit zahlreichen Artikeln zur Chronologie der Papyrusdokumente des byzantinischen Ägypten (siehe die Bibliographie in CSBE) gewissermaßen kommentierend begleitet haben – bedarf diese Neuauflage der CSBE sicherlich keiner Rechtfertigung. Auch wenn mit der Volltextdatenbank der „Duke Data Bank of Documentary Papyri“ (DDBDP) sowie mit dem „Heidelberger Gesamtverzeichnis der griechischen Papyrusurkunden Ägyptens“ (HGV) nunmehr – zum Zeitpunkt der Erstauflage der CSBE noch nicht existente – äußerst nützliche digitale Ressourcen zur Verfügung stehen, die die Sammlung und chronologische Auswertung der Dokumente bedeutend erleichtern (worauf B&W in der Einleitung zu CSBE zu recht hinweisen [viii]), so ist dies zweifellos immer noch eine mühe- und entsagungsvolle Kärrnerarbeit, für die den beiden Autoren nicht hoch genug gedankt werden kann. Hinzu kommt, daß sich diese Arbeit nicht nur auf die Sammlung der Dokumente und der ggfs. seit ihrer Edition erfolgten Berichtigungen beschränkt, sondern B&W in zahlreichen Fällen auch selbst Lesungen überprüft und berichtigt haben. Using recent work by Forster and Sober, I identify circumstances in which appeals to symmetries in physical laws are rational with respect to the aim of predictive accuracy. I then consider a Bayesian account of symmetry, and argue that such an account faces serious problems explaining when and why appeals to symmetry would be rational.

The theory of epistemic deontologism is an area of normative epistemology. It is concerned with the application of deontic notions such as obligation, permission, blame and praise in epistemic contexts. Nottelmann’s book “Blameworthy Belief” deals with the applicability of one of the central notions of epistemic deontologism, namely the concept of epistemic blameworthiness.But the study goes beyond the analysis and introduction of this concept. The last 20 years have witnessed the dramatic growth of the animal rights movement and a concurrent increase in its social scientific scrutiny. One of the most notable and consistent findings to emerge from this body of research has been the central role of women in the movement. This paper uses General Social Survey data to examine the influence of views of the relationship of humanity to nature on this gender difference. Holding a Romantic view of nature is associated with (...) higher levels of support for extending moral rights to animals and lower levels of support for animal-based testing. A Darwinian view is associated with greater support for testing on animals but is unrelated to views on moral rights for animals. In general, views of nature affect animal rights advocacy to a greater extent among males than females. (shrink)

: In his landmark book, Peirce's Theory of Signs, T. L. Short argues that music signifies as a pure icon. A pure icon, according to Peirce, is not a likeness. It "does not draw any distinction between itself and its object" (EP2:163), and it "serves as a sign solely and simply by exhibiting the quality it serves to signify" (EP2:306). In music, this quality consists of the specifically musical feelings or ideas contained in the piece in question, and such musical (...) feelings are properly interpreted by means of an emotional interpretant rather than an energetic or logical one. Short, following Peirce, is correct in maintaining that music primarily signifies feeling-content whose proper means of expression is musical and whose proper interpretation by the listener involves the generation of a corresponding feeling. Nonetheless, musical signification is not purely iconic. Responding to the musical feelings presented in a work requires previous acquaintance with its style tradition, and this acquaintance involves logical interpretants. In addition, the integral temporality of music calls into question the possibility of its being purely iconic. (shrink)

Jamieson et al. provide an overview of the biopsychosocial model of threat and challenge and suggest that stress-related arousal can be reappraised as a coping resource to facilitate challenge appraisals. Hernandez et al. review evidence for the link between well-being and health. We see a connection between these seemingly unrelated reviews: Well-being may improve health in part by shaping appraisals of stressors’ demands and appraisals of (...) coping resources. (shrink)

The aim of this paper is to argue that doxastic responsibility, i.e., responsibility for holding a certain doxastic attitude, is not based on direct doxastic control. There are two different kinds of direct doxastic control to be found in the literature, intentional doxastic control and evaluative doxastic control. Although many epistemologists agree that we do not have intentional doxastic control over our doxastic attitudes, it has been argued that we have evaluative doxastic control over the majority of our doxastic attitudes. (...) This has led to the assumption that doxastic responsibility is based on evaluative doxastic control. In the first part of this paper I will introduce the notion of doxastic responsibility and the framework of doxastic guidance control as well as the approaches to direct and indirect doxastic control. I will then argue that doxastic responsibility is not based on direct doxastic control by showing that doxastic responsibility is neither based on intentional nor on evaluative doxastic control. I present a justification for the intution that more-varied data are more valuable than the same number of less-varied data by showing that the more-varied data help to improve the accuracy of our predictions.

Based on an ethnographic study of fingerprint and DNA evidence practices in the Swedish judicial system, this article analyses the materialization of forensic evidence. It argues that forensic evidence, while popularly understood as firmly rooted in materiality, is inseparably technoscientific and cultural. Its roots in the material world are entangled threads of matter, technoscience and culture that produce particular bodily constellations within and together with a particular sociocultural context. Forensic evidence, it argues further, is co-materialized with crimes as well as (...) with particular bodily and social constellations. Consequently, the article suggests that an analysis of how forensic evidence is produced can contribute to feminist understandings of the inseparability of sex and gender: understanding bodies as ongoing technoscientific-material-cultural practices of materialization may be a fruitful approach to analysing their complexity, and the relationships in which they are placed, without surrendering to either cultural or biological determinism. Taking a theoretical point of departure not only in an STS-informed approach, but also in material feminist theorizations, the article also underlines that the suggested theoretical conversations across borders of feminist theory and STS should be understood as a two-way-communication where the two fields contribute mutually to each other. Gestalt theory is discussed as one main precursor of synergetics, one of the most elaborated theories of self-organization. It is a precursor for two reasons: the Gestalt theoretical view of cognitive order-formation comes dose to the central ideas of self-organization. Furthermore both approaches have stressed the significance of non-linear perceptual processes (such as multistability) for the solution of the mind-brain problem. The question of whether Gestalt theory preferred a dualistic or a monistic view of the mind-body relation is answered in (...) that there was a preference for dualism in epistemological questions and for monism in the mind-brain relation. The latter was attained by the concept of psychophysical isomorphism. This concept, although widely misunderstood in many respects, was criticized on the basis of neurobiological findings. One main objection was the neglect of the importance of the elementary neurophysiological processes. A distinction between macroscopic and microscopic brain processes seemed to be required. This idea was taken up in synergetics which postulates a bottom-up and top-down interaction between these two levels. Macroscopic order emerges from elementary brain processes and, at the same time, has a backward slaving effect to the microscopic level In the light of such holistic emergentism, the question whether macroscopic order states might be attractors for psychological meanings is discussed. In recent years, the issue of experimentation upon nonhuman animals has become the subject of media attention. One aspect of the media presentation is the status attributed to claims-makers on either side of the issue. Research suggests that perceived expertise of the source of arguments can play a role in attitudes formed by audiences. This study examines mainstream print and broadcast media presentation of the status of individuals quoted regarding the issue of animal experimentation. Those supporting continued experimentation are significantly (...) more likely to be presented as professionals or experts. Attitude formation is discussed in light of these findings. (shrink)

Against Hellman's (1997) recent claims, I argue that Bayesianism is unable to explain the value of generally successful aspects of scientific methodology, viz., deflecting blame from well-confirmed theories onto auxiliaries and preferring more-varied data. Such an explanation would require not just objectification of priors, but a reason to believe priors will generally fall on values that justify the practice. Given the track record on the objectification problem, adding further conditions on priors merely makes the Bayesian's problems even worse.

We report the results of an experimental test of whether preaching the normative appeal of the sure-thing principle leads decision-makers to make choices that satisfy it. We use Allais-type decision problems to observe the incentive-compatible choices of 147 subjects, which either violate the sure-thing principle or adhere to it. Subjects are presented with normative arguments that support the counterfactual behaviour and then repeat their decisions. We observe violations of the sure-thing principle are robust to its normative justification. This result replicates (...) a famous small-sample observation using hypothetical tasks that was published by Paul Slovic and Amos Tversky almost half a century ago. We argue that this finding is as relevant now as it was then and that their design can be usefully applied to address contemporary issues in behavioural economics. (shrink)

This research proposes that broad-based employee share ownership (ESO) affects corporate environmental performance (CEP). Drawing upon corporate governance literature, social exchange theory, and stakeholder utility theory, we propose that employees as owners adopt more favorable attitudes toward beneficial outcomes for CEP, and that the broad-based impact of ESO overwhelms the impact of CEO ownership. Also, we propose that these relationships are contingent upon trade union presence as a form of worker voice that amplifies the ESO influence on CEP. The empirical (...) results from U.S. publicly traded companies from 2009 to 2016 indicate that broad-based ESO is linked to positive CEP by companies, and provides some support for all proposed hypotheses. This study provides scholarly and practical implications for the effects of shared capitalist modes of ownership and employee engagement on corporate sustainability. (shrink)

In 1860 he began publication in Cincinnati of The Dial, successor to the New England transcendentalist journal, and used its pages to promote religious liberalism, philosophical transcendentalism, and social reform. In 1863 he went to London where he became the head of the Ethical Society. Under the influence of Feuerbach and "left-Hegelians" he travelled widely in the (...) interests of "free thought." The most amazing of these four, however, is August Willich: an East Prussian soldier, ready to fight again to restore the 1848 revolution in Germany, discouraged by Marx from doing so, emigrating to Cincinnati to raise funds among the German 1848 refugees there and urging them to continue the lost cause in Germany, then wholeheartedly fighting for the Union Cause as a General in the Civil War, and finally joining the Populist revolt. As Easton points out, these four all illustrate the close relation between Hegel and the spirit of 1848. In addition to the stories of these men and their ideals, the volume contains a hundred pages of excellent specimens of their writngs, and copious references to obscure source-materials. The late Argentinian philosopher Francisco Romero, who died unexpectedly in 1962 after a brilliant career of more than thirty years of teaching and writing, was by common acclaim of his fellow-philosophers in Latin America their most distinguished philosopher in recent years. He received many honors and distinctions both at home and abroad, including the grand award of honor of the Argentinian Society of Writers. The most eminent philosophers in Latin American prepared a notable Festschri]t in honor of his 70th birthday, whose publication was unfortunately delayed and, therefore, could not be presented to him personally in his life time.1 Franci~o Romero was in fact as well as in acclaim the "Dean of Latin American Philosophy." It was high time that his central work Teorga del Hombre 2 should be translated. It is his magnum opus and represents the most comprehensive and systematic development of his philosophy. Romero was fortunate in having as his translator William F. Cooper who knew Romero personally, and was intimately acquainted with his philosophy. Social entrepreneurship increasingly contributes to diversity in entrepreneurship. The different approaches to SE suggest a variety of antecedents which drive individuals' intention to become social entrepreneurs. While this variety of antecedents is insightful, it also creates a need for systemisation and prioritization. We address this need by introducing an integrative, multi-level framework for person-based antecedents of SE-intention. Based on this multi-level framework the antecedents are grouped on three theoretical levels which refer to an individual's personality, cognition, and entrepreneurial exposition. When (...) testing our framework with 499 South African University students we find support for the multi-level framework and its notion that antecedents from the diverse levels complement each other. Therefore, this study provides a structure for person-based antecedents of SE-intention and additionally points to future research which may extend the proposed framework. (shrink)

This paper explores the condition of stultitia, which is described by Michel Foucault in The Hermeneutics of the Subject as a condition one is in, before having started to care for the self. The purpose is to shed light on one of the paradoxes of patient education by introducing and elaborating an aspect of Foucault’s literary activities, which has not, to my knowledge, been investigated empirically before. To illustrate this condition, the paper targets the relation between type 2 diabetes, contemporary (...) norms of healthy living, diabetes education, and the situation that sometimes occurs when individuals are not capable of, or motivated to, taking care of themselves. It specifically targets a situation, which is both incomprehensible to health professionals and patients alike; when patients desire a healthy life, but at the same time do not pursue it according to the recommendations. Thus, it is a condition of madness, which is investigated; madness in the sense that patients have internalised a rationality, against which their own behaviour rebels. (shrink)

In this paper, we advance a novel conception of normative ethics and draw out its implications within the domain of professional ethics. We argue that all moral agents, and thus professionals, share a fundamental and constitutive normative interest in correctly conceiving of their ends. All professionals, we claim, by virtue of their positions of social power, have special role responsibilities in cultivating and sustaining societies oriented by this shared ideal of practically oriented ethical understanding. We defend this conception against a (...) familiar opponent of a philosophical approach to professional ethics: the morally skeptical student. By taking the skeptic’s challenge seriously, we clarify the conditions for a sound account of normative ethics and then provide a response that meets this test. The speech of the Armenian embassy to Khusrow in the opening of Book 2 of Procopius'Warshas received little scholarly attention. Historians propose that this embassy, along with those sent by the Goths and Lazi, provided Khusrow with a pretext for violating the Eternal Peace in 540. As for the speeches themselves, they have been considered formulaic set pieces, requirements of the genre in which Procopius was writing. However, Anthony Kaldellis has argued that Procopius uses the Armenians as a mouthpiece for (...) his own criticisms of Justinian, namely that the emperor is to blame for ending the Eternal Peace and that he behaved like an oriental despot. While these literary and historical readings are not incompatible, none fully explicates the mechanics and function of the Armenians' speech. (shrink)

In 2011, Ingmar Riedel‐Kruse's bioengineering laboratory at Stanford University publicized an application that uses paramecia for what the researchers termed “biotic games.” These games make use of living organisms, computer programs, and lab equipment to implement games like Pong, Pac‐man, and soccer. Gamesand related activities are often considered nonserious or trivial, whereas life, biological systems, and science are treated very seriously in moral analysis and public perception. The manipulation of living matter frequently engenders at least some controversy in the (...) marketplace of ideas, and using living things in games is no exception. Some of the objections lodged against biotic games have appeared in the ethics literature on similar topics; however, the addition of an entertainment element introduces some objections distinct from those about similar cases, as the online comments vividly illustrate. We aim to explore and address the objections in this paper, using the comments to organize and launch the discussion. In scientific work, there is typically a presumption of some prospect of translation and application of generated knowledge for public benefit. In the case of biotic games, these applications are not self‐evident. Because of this, a serious analysis of the justifications, limitations, and features of biotic games is warranted. To this end, we outline key ethical limits that ought to be placed on these activities as well as the obligations that these activities generate for researchers, other professionals, and lay people who design, implement, use, and play them. The paper links a debate in the history of medical science between statistics and the experimental method with contemporary diabetes educational practices. An empirical example of a tension between neglect and concern in diabetes self-regulation frames the subsequent theoretical discussion between first, Claude Bernard and statistics and afterwards, Georges Canguilhem as a correlative to Bernard. Through these philosophers of medical science a connection between the experimental method and education is demonstrated. Finally, a case description of an experimental approach to alcohol (...) and experimentation frames and highlights the educational aspect of the methodological discussion. (shrink)
